EULA - End User License Agreement

MELTED GAMES END USER LICENSE AGREEMENT

IMPORTANT-READ CAREFULLY BEFORE INSTALLING OR USING THE SOFTWARE:
This Melted Games End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Melted Games for the Melted Games software product "Autofrag: SUMO", which includes computer software and associated documentation ("Software"). The Software also includes any updates and supplements to the original Software provided to you by Melted Games. By installing, copying, downloading, accessing or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA: (i) do not use or install the Software, and (ii) if you have purchased the Software, promptly return the Software and all accompanying materials with proof of purchase to your place of purchase for a refund.

SOFTWARE LICENSE

The Software is confidential and protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold.

GRANT OF LICENSE. This EULA grants you a non-exclusive, non-transferable and non-sublicenseable license to install and use a copy of the Software for your personal non-commercial home entertainment use on one personal computer. By accepting this agreement, you do not become the owner of the product in accordance with the Agreement. You agree to use your best efforts and to take all steps to protect the product from unauthorised use, illegal production or reproduction or illicit distribution.

OTHER RIGHTS AND LIMITATIONS.
* No Commercial Use. You may not use the Software for any commercial purpose, including: distribution (electronically or otherwise), resale, rental, lease, display or offering on a pay-per-play coin-op or other for charge basis.
* Transfer. You may not rent, lease, sell, sublicense, lend or otherwise transfer or assign your rights or obligations under this EULA to any person or entity.
* Reservation of Rights. Melted Games reserves all rights not expressly granted under this EULA.

TERMINATION OF THE AGREEMENT

If any terms and conditions of this Agreement are broken Melted Games has the immediate right to terminate in writing the Agreement and demand that you return the product to Melted Games. At that time, you must also certify in writing that you have not retained any copies of the product.

COPIES. Melted Games and its suppliers retain all ownership of the Software and all copies thereof. Except as expressly provided in this EULA, you may not make copies of the Software, except as reasonably necessary to run, install or use the Software in accordance with the uses for which you have been granted this EULA.

GOVERNING LAW

This Agreement is to be governed by and interpreted by and in accordance with the Laws of England.

Any terms and conditions of this Agreement found to be unenforceable will be considered for deletion, but will not affect the remaining terms and conditions of this Agreement.

NO WARRANTY. LICENSOR AND ITS SUPPLIERS MAKE NO, AND HEREBY DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED AND STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS WITH RESPECT TO THE SOFTWARE PRODUCT. LICENSOR AND ITS SUPPLIERS DO NOT WARRANT THAT THE SOFTWARE PRODUCT IS ERROR-FREE OR THAT ACCESS TO THE SOFTWARE PRODUCT WILL BE UNINTERRUPTED AND WITHOUT COMPROMISE TO SECURITY SYSTEMS. YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SOFTWARE PRODUCT IS "AS IS," AND "AT YOUR OWN RISK."

LIABILITY

You agree that regardless of the form of any claim you may have that Melted Games liability for any damages to you or any other party shall not exceed the license fee paid for the Software.

MELTED GAMES WILL NOT BE RESPONSIBLE FOR ANY DIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES SUCH AS BUT NOT LIMITED TO LOSS OF PROFITS RESULTING FROM THE USE OF THIS SOFTWARE OR ARISING OUT OF ANY BREACH OF THE WARRANTY EVEN IF MELTED GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
